These terms and conditions explain the rules for using The Note website at thenote.com.au, along with any related pages, forms and services we offer online. Please read them carefully. By browsing the site, subscribing to our newsletter, submitting a gig, entering a competition or otherwise using the site, you agree to these terms. If you do not agree, please do not use the site.

Who we are

The Note is an independent Australian music and culture publication based in South Australia. In these terms "The Note", "we", "us" and "our" refer to HWR Media Pty Ltd, the publisher of The Note magazine and thenote.com.au. You can reach us at info@thenote.com.au or on (08) 8379 9522.

Changes to these terms

We may update these terms from time to time as the site grows and our services change. The current version will always be published on this page with the date it last changed. If you keep using the site after we update the terms, that means you accept the updated version.

Using the website

You are welcome to read, share and enjoy our content for your own personal, non-commercial use. When you use the site you agree not to

• use it for any unlawful purpose or in a way that breaches these terms
• copy, republish or resell our content without our written permission
• submit false, misleading, offensive or infringing material through any of our forms
• attempt to interfere with, damage or gain unauthorised access to the site, its servers or its data
• use automated tools to scrape or harvest content or personal information from the site

We may suspend or restrict access for anyone who breaches these terms.

Our content and intellectual property

All articles, reviews, photography, videos, artwork, logos and design on the site are owned by The Note or used with permission, and are protected by copyright and other intellectual property laws. The Note name, logo and Teen Spirit branding belong to us. You may share links to our articles and quote short extracts with clear credit to The Note, but you cannot reproduce, adapt or republish substantial parts of our content without our written consent.

Photography and supplied material

Many images on the site are created by photographers or supplied by artists, labels, venues and promoters, and are credited where possible. These remain the property of their creators or licensors and are used by The Note with permission. If you believe your work has been used incorrectly or without proper credit, contact us at info@thenote.com.au and we will look into it promptly.

Accuracy of information

We take care to publish accurate and fair content, but some of our work is opinion based and reflects the personal views of the writer. Information can also date quickly in a fast-moving industry. Gig listings, tour dates, prices, event details and other practical information are provided as a guide only and can change without notice. We recommend you confirm details with the venue, promoter or ticket seller before making plans or purchases. Any opinions expressed in articles are those of the authors and do not necessarily represent the views of The Note.

Newsletter and subscriptions

When you sign up to our newsletter you are asking us to send you news, event information and occasional promotions by email. We will only add you to our list when you give us permission, and you can unsubscribe at any time using the link in any email or by contacting us. How we handle your personal information is set out in our Privacy policy.

Gig guide and gig submissions

Our gig guide includes listings submitted by artists, venues, promoters and members of the public. When you submit a gig you confirm that

• the information you provide is accurate and you are allowed to share it
• you have permission to promote the event and to use any names or details included
• we may publish, edit, shorten, decline or remove your listing at our discretion

All submissions are moderated and we do not guarantee that a listing will be published or that it will appear by any particular date. Listings are published in good faith and we are not responsible for events that are changed, postponed or cancelled, or for any dealings between you and a venue, promoter or ticket seller. If you need a listing corrected or removed, contact us at info@thenote.com.au.

Competitions

From time to time we run competitions where you can win tickets, records and other prizes. Each competition has its own specific terms shown on the competition page or entry form, covering who can enter, how to enter, the prize, the entry period and how winners are chosen. Those specific terms apply in addition to these general terms, and if there is any conflict the specific competition terms will prevail.

Unless a competition says otherwise

• entry is open to Australian residents only
• entrants under 18 need the permission of a parent or guardian, and we may ask for proof of that permission
• one entry per person applies
• prizes are not transferable or exchangeable and cannot be redeemed for cash
• we may use the first name and general location of winners to announce results, with their consent
• our decisions about eligibility and winners are final

Some competitions may be subject to regulations or permit requirements depending on where and how they run. We will make sure each competition we run complies with the rules that apply to it.

Advertising and sponsored content

The site carries advertising, sponsored placements and partner content that help fund our independent journalism. Advertising and sponsored material is provided by third parties and we are not responsible for the accuracy of their claims or the quality of their products and services. Where content is paid for or sponsored we will identify it as such. If you would like to advertise with us you can request our media kit through the Advertise page, and any advertising booking will be covered by a separate agreement.

Links and embedded content

The site links to and embeds material from other services, including ticket sellers, venue pages, our digital magazine reader, maps, music players and social media. We provide these for your convenience and we do not control or endorse those third-party sites and services. Once you leave The Note or interact with an embedded service, that provider's own terms and privacy practices apply, and we are not responsible for their content or how they handle your information.

Young people and Teen Spirit

The Note, including our Teen Spirit platform, is made partly by and for young people and covers all-ages events. Young people are welcome to read the site and take part in our content. If you are under 18 you should have the permission of a parent or guardian before you submit anything to us, enter a competition or provide your personal information, and by doing so you confirm you have that permission. We take extra care with content involving young people and we ask parents and guardians to supervise their use of the site.

Privacy

We respect your privacy and only collect personal information you choose to give us, such as your email address or the details you include in a form. How we collect, use and protect that information is explained in our Privacy policy, which forms part of these terms.

Availability of the site

We work to keep the site running smoothly but we cannot promise it will always be available, uninterrupted or free of errors. We may change, suspend or withdraw parts of the site at any time without notice. From time to time access may be affected by maintenance or by issues outside our control.

Our responsibility to you

Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to those rights, we provide the site and its content on an "as is" basis and, to the extent the law allows, we are not liable for any loss or damage that results from using the site, relying on its content or being unable to access it. Where we are liable and the law allows us to limit that liability, our liability is limited to resupplying the relevant content or service.

Governing law

These terms are governed by the laws of South Australia and the Commonwealth of Australia. Any dispute about these terms or your use of the site will be handled by the courts of South Australia.
